General Questions
Do I need a visa to visit the UK?
Whether you need a visa to visit the UK depends on your nationality. Citizens of many countries can visit the UK visa-free for up to 6 months for tourism or business. However, nationals of many other countries must apply for a Standard Visitor Visa before travelling. You can check whether you need a visa on the UK Government’s official website (gov.uk).
What is the difference between ILR and Settled Status?
Indefinite Leave to Remain (ILR) is granted to non-EU nationals who have lived lawfully in the UK for the required period. Settled Status is granted to EU, EEA and Swiss nationals (and their family members) under the EU Settlement Scheme. Both give you the right to live, work and study in the UK indefinitely and are a route to British citizenship.
How long does a UK visa application take?
Processing times vary depending on the visa type and where you are applying from. As a general guide: Standard Visitor Visas typically take 3 weeks; Spouse/Partner Visas take 8–12 weeks; Skilled Worker Visas take 3–8 weeks; ILR applications take 6 months; Citizenship applications take up to 6 months. Priority services are available for most routes at an additional fee.
Partner & Spouse Visas
What is the minimum income requirement for a Spouse Visa?
As of 2024, the minimum income threshold for a Spouse/Partner Visa has increased to £29,000 per year. This is expected to rise further. The income can come from employment, self-employment, pension, savings over £16,000, or a combination of these. We can assess your financial circumstances and advise on whether you meet the requirement.
Can I work on a Spouse Visa?
Yes. Holders of a UK Spouse/Partner Visa have the right to work in the UK without any restrictions. You can take up employment, change jobs, or become self-employed.
My partner visa was refused — what can I do?
If your visa application was refused, you may have the right to appeal to the First-tier Tribunal (Immigration and Asylum Chamber) or apply for an administrative review. The best course of action depends on the reasons given for the refusal. Contact us as soon as possible as there are strict time limits for lodging appeals.
Settlement & Citizenship
How long do I need to live in the UK to apply for ILR?
Most visa routes require 5 years of continuous lawful residence before you can apply for ILR. Some routes such as the Global Talent Visa (accelerated route) allow ILR after 3 years. The 10-Year Long Residence route requires 10 consecutive years of lawful residence.
How long after getting ILR can I apply for British Citizenship?
You can apply for British Citizenship by Naturalisation 12 months after receiving ILR (or immediately if you are the spouse or civil partner of a British citizen). You must also have met the English language requirement, passed the Life in the UK Test, and demonstrated good character.
Business Immigration
How long does it take to get a Sponsor Licence?
A standard Sponsor Licence application takes approximately 8 weeks to process. A priority service is available for £750 which aims to provide a decision within 10 working days, though this is subject to availability.
What is a Certificate of Sponsorship (CoS)?
A Certificate of Sponsorship (CoS) is an electronic record issued by a licensed sponsor to an overseas worker as part of their UK visa application. It confirms the job details and that the employer is sponsoring the worker. You must have a valid CoS before applying for most work visas.
